Terms of Use

1. About these terms

These Terms of Use ("Terms") govern your access to and use of the Property Filter website and platform. Please read them carefully. By ticking the box to accept these Terms when you create an account, or by accessing or using the service, you agree to be bound by them. If you do not agree, you must not use the service.

These Terms work alongside our Privacy Policy, Cookie Policy, Community Terms of Service (if you use the Property Filter Community) and Disclaimer. We recommend you save or print a copy.

2. Who we are

The service is provided by Property Filter Limited ("Property Filter", "we", "us", "our"), a company registered in England and Wales under company number 13311178, with its registered office at Union House, 111 New Union Street, Coventry, West Midlands, CV1 2NT.

3. The service

Property Filter is a software platform and membership providing property data, deal-sourcing tools, calculators, educational content and access to a member community, to help you research and assess UK property opportunities. We may add to, change or remove features to improve the service. We will not make changes that materially reduce the core service you have paid for without telling you (clause 9).

3.1 The service is information and tools, not advice

The data, tools, calculators, figures, estimates, templates, educational material and community content are for general information and research only. They do not constitute financial, investment, mortgage, tax, legal, valuation or other professional advice, and must not be relied on as such.

Property values, rents, yields and projections are estimates and may be inaccurate or out of date. You are responsible for your own due diligence and for any investment or business decision you make, and we recommend you take independent professional advice before acting. We are not authorised or regulated by the Financial Conduct Authority and we do not provide regulated financial services. See our Disclaimer for more.

3.2 Beta and early-access features

We may offer some features on a beta or early-access basis for testing and evaluation. These are provided "as is", may be changed or withdrawn at any time, and may be less reliable than our standard features. To the extent permitted by law, we are not liable for issues arising from beta features, and using a beta feature does not oblige you to take any paid plan.

4. Eligibility and your account

You must be at least 18 years old to use the service.

You must provide accurate, current and complete information when you register, and keep it up to date.

Each account and login is personal to you, on a per-user basis. You are responsible for keeping your password confidential and for all activity under your account.

Tell us promptly at hello@property-filter.co.uk if you believe your account has been accessed without your permission. We will never ask you to disclose your password.

5. Licence to use the service

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the service for your own property research and business purposes, on a per-user basis, for as long as your subscription is active and you comply with these Terms.

You may view content on screen and download or print materials made available for that purpose, for your own use. You may not share, resell, sublicense, redistribute or commercially exploit the service or its content except as expressly allowed in these Terms.

5.1 Mobile applications

We provide Property Filter mobile apps for iOS (Apple App Store) and Android (Google Play). Your use of an app is also subject to the relevant app store's terms. To the extent you use our iOS app: these Terms are between you and Property Filter, not Apple; Apple has no obligation to provide support; if the app fails to meet an applicable warranty you may notify Apple, and Apple will refund any purchase price paid; Apple is not responsible for product-liability, intellectual-property or consumer-protection claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. To the extent you use our Android app, Google and its affiliates are likewise third-party beneficiaries in relation to the app. You confirm you are not located in a country subject to a UK or US Government embargo and are not on a restricted-parties list.

6. Acceptable use and fair use

You agree not to:

share your login, or allow more users than your subscription covers to access the service;

scrape, harvest, bulk-extract, mirror or systematically copy data by any automated means (including spiders, bots, crawlers and data-mining tools), except via an interface we expressly provide;

resell, republish, license or distribute the data or content as, or as part of, a competing product or service;

use the service in breach of any applicable law, or to infringe anyone's rights;

introduce malware, attempt to gain unauthorised access to the service or its systems, or interfere with its normal operation (including by denial-of-service attacks);

publish personal or confidential information about any person without a lawful basis.

We operate a fair-use approach to protect performance for all members. If your usage is excessive or appears automated, we may contact you, apply reasonable limits, or suspend access. If a breach causes us loss, we may recover the reasonable costs we actually incur; we do not apply fixed penalties to consumer accounts.

7. Free trial, subscriptions and automatic renewal

7.1 Free trial

We offer an 8-day free trial. To start it you must provide valid payment details and authorise us (and our payment processor, Stripe) to charge your chosen payment method when the trial ends, unless you cancel first. Each person is entitled to one free trial.

7.2 Plans, prices and automatic start

Subscription plans, their features and prices (stated exclusive of VAT, with VAT added at checkout) are shown on our pricing page and confirmed at checkout. Unless you cancel before the trial ends, your paid subscription starts automatically at the end of the trial and we charge the fee for your chosen plan and billing period (monthly or yearly).

7.3 Automatic renewal

Your subscription renews automatically at the end of each billing period at the then-current price, using your payment method on file, until you cancel. We will tell you in advance of any price change (clause 9).

7.4 Reminders

We will email you a reminder before your free trial ends and before each renewal, to the address on your account, so you can decide whether to continue.

7.5 Failed payments

If a payment fails, we may retry it and may suspend your access until payment is made. Where the Community is part of your subscription, suspension may also affect community access (see the Community Terms of Service).

8. Your right to cancel and refunds

8.1 Cancelling at any time

You can cancel at any time from your account (Account Settings, then Membership, then Cancel Plan) or by emailing hello@property-filter.co.uk. Cancellation stops the next renewal; your access continues until the end of the period you have already paid for. Once you cancel, we will not take any further payment from your card.

Please note that Community access is part of your subscription. If you cancel, you will lose access to the Property Filter Community, and your community data is typically removed around 90 days afterwards, so please export anything you want to keep before then.

8.2 14-day cooling-off right (consumers)

If you are a consumer (an individual buying mainly outside your trade, business or profession), you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel within 14 days of entering into the contract, without giving a reason.

Because the service is digital and made available to you immediately: by starting to use the service during the 14-day period, you ask us to begin providing it straight away and acknowledge that you lose the right to cancel once it has been fully performed; and if you cancel within the 14-day period after asking us to start, we may charge a proportionate amount for the service used up to the point you tell us. To exercise this right, email hello@property-filter.co.uk within 14 days. You may use the model wording in Schedule 1.

8.3 Our refund promise

We put customer satisfaction first:

14-day money-back guarantee. If you are not happy, tell us within 14 days of your first payment and we will refund it in full, no questions asked.

After that, your statutory rights continue to apply, and we will still consider a goodwill refund on a case-by-case basis.

Submit requests through your account or to hello@property-filter.co.uk. We aim to process approved refunds within 5 working days.

Nothing in this clause limits your statutory rights as a consumer.

9. Changes to prices and to these Terms

We may change our prices and these Terms. If a change materially affects your rights or the price you pay, we will give you at least 30 days' notice by email. Price changes take effect from your next billing period after the notice. If you do not agree to a material change, you may cancel before it takes effect, and we will refund any pre-paid, unused period on a pro-rata basis.

10. Intellectual property

The service, the platform, the underlying database and software, and all content we make available (excluding your own content and personal data) are owned by or licensed to Property Filter and are protected by copyright, database rights, trade marks and other rights. All rights not expressly granted to you are reserved. "Property Filter" and our logos and product names are our trade marks; you may not use them without our prior written permission.

10.1 Your content

You keep ownership of any content you submit. You grant us a non-exclusive, royalty-free, worldwide licence to host, store, copy, adapt and display that content (a) to operate and provide the service, and (b) to promote Property Filter, including by featuring community contributions, reviews and testimonials in our marketing and across any media. We do not claim ownership of your content. If you ask us to stop using a specific identifiable contribution of yours in marketing, we will stop using it going forward. Content you post in the Community is also covered by the Community Terms of Service.

11. Third-party links and services

The service may link to or integrate with third-party websites and services. These are provided for convenience and are not an endorsement. We are not responsible for third-party content, security or practices, and your use of them is subject to their terms.

12. Availability and disclaimers

We work to keep the service available and accurate, but we provide it "as is" and "as available". We do not guarantee it will be uninterrupted, error-free, or that the data is complete or accurate. We may suspend the service for maintenance, upgrades or reasons outside our control. Nothing here affects consumers' statutory right to services provided with reasonable care and skill under the Consumer Rights Act 2015.

13. Our liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited by law (including consumers' statutory rights).

Subject to that:

We are not liable for loss that was not foreseeable, for any investment, business or financial decision you make based on the service, or (for business users) for loss of profits, revenue, business, goodwill, data or anticipated savings, or for indirect or consequential loss.

Our total liability arising out of or in connection with the service, whether in contract, tort (including negligence) or otherwise, is limited to the total fees you paid us in the 12 months before the event giving rise to the claim.

If you are a consumer, the service is provided for your personal property research, and we are not responsible for business losses.

14. Indemnity (business users only)

If you use the service for business purposes, you agree to indemnify us against losses, damages and reasonable costs arising from your breach of these Terms, your misuse of the service, or content you submit that infringes a third party's rights or breaks the law. This clause does not apply to consumers.

15. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, if your account is genuinely overdue, if required by law, or if we reasonably suspect unlawful activity. Where reasonable, we will give notice and a chance to put things right first. You may terminate by cancelling and closing your account at any time.

15.1 What happens to your data

If your subscription ends, we will keep your account data available to you for a reasonable period so you can reactivate or export it, and we will give you notice before deleting it. Community content is removed in line with the Community Terms of Service (around 90 days after cancellation). We retain and delete personal data as set out in our Privacy Policy, and we will not delete data without notice.

16. Events outside our control

We are not liable for failure or delay caused by events outside our reasonable control (for example outages of third-party infrastructure, internet failures, or acts of government). If such an event continues for a long period, either of us may cancel future periods and we will refund any pre-paid, unused fees.

17. General

Whole agreement. These Terms, the Privacy Policy, the Cookie Policy, the Community Terms of Service and the Disclaimer are the whole agreement between us about the service.

Assignment. You may not transfer your rights. We may transfer ours if your rights are not adversely affected.

Severance. If any part is unenforceable, the rest continues to apply.

No waiver. Not enforcing a right immediately does not waive it.

Third parties. No one other than you and us has rights under these Terms.

18. Complaints

We aim to provide a professional service. If something goes wrong, please tell us so we can put it right:

Raise it. Put your complaint in writing to hello@property-filter.co.uk, with as much detail as possible (dates, names, and any supporting evidence).

Acknowledgement. We acknowledge it within 3 working days and begin our internal process.

Investigation. A senior member of staff provides a formal written response within 15 working days of receipt.

Final review. If our proposal does not resolve it, tell us why and a director will review and issue a final response within 15 working days.

19. Governing law and jurisdiction

These Terms and any dispute relating to them are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer living in another part of the UK you may also bring proceedings in your home courts.

You may use this wording to cancel within the 14-day cooling-off period. You do not have to.
